UKSC reject Simcoe appeal

Simcoe appeal to the Supreme Court rejected

The Supreme Court has refused permission to appeal in the case of Simcoe v Jacuzzi UK Group plc.

Stating:

“Permission to appeal be refused because the application does not raise an arguable point of law of general public importance which ought to be considered by the Supreme Court at this time, bearing in mind that the case has already been the subject of judicial decision and reviewed on appeal; this is a point of practice and procedure more suitable for consideration at Court of Appeal level”.

This decision effectively means that the decision that interest is recoverable from the date of the authority for assessment in all CFA-funded cases is unlikely to change without any legislative intervention.
